What is Notice Period

WHAT IS NOTICE PERIOD?

It’s unfair for an employer to simply walk into your office and fire you. At minimum they need to provide notice or payment in lieu of notice.  In other words, payment instead of providing you with notice.

HOW MUCH NOTICE? 

The Employment Standards Act., in Ontario provides the basic minimum notice period.  However, the appropriate notice period can be based on a variety of factors. For this reason its important to speak with an Employment Lawyer.

WHEN DOES MY EMPLOYER NOT HAVE TO PROVIDE NOTICE?

An employer does not necessarily have to provide notice if they feel your termination is with cause. In this situation they deem the offence or conduct to be of a seriousness nature. Thus, negating any requirement to provide notice. However, the contested issue here is often whether the wrongful termination was truly with cause.
